DUNGEONS & DRAGONS ONLINE® END USER LICENSE AND PREVIEW AGREEMENT

Thank you your interest in the Preview Program (the “Preview Program” or “Preview”) for Turbine, Inc.’s (“Turbine”) massively multiplayer online role-playing game Dungeons & Dragons Online™ (the “Game”). THIS AGREEMENT IS A LEGALLY BINDING CONTRACT; PLEASE READ IT CAREFULLY.

Through the Preview Program, we hope to provide you with an opportunity to experience and help test the pre-release version of the Game before it is made available to the public. Please be aware that during the Preview Program, you may only see an incomplete portion of the Game which may, or may not, resemble the final release. We hope that you are as excited about this as we are.

Your participation in the Preview Program, including use of (a) the software program (the “Game Client”), (b) Turbine’s online component (the “Game Server”), and (c) any updates or expansion packs provided by Turbine (collectively with the Game Client and the Game Server, the “Game”), is subject to this End User License and Preview Agreement (the “EULA” or “Agreement”) and the Terms of Service (the “TOS”) incorporated herein by this reference: Terms of Service

Limited License. The Game Client is licensed, not sold. Subject to your agreement to and continued compliance with the terms and conditions of this EULA, Turbine hereby grants to you a limited, revocable, non-exclusive license to (a) download and install the Game Client onto a personal computer owned by you, and (b) use a single copy of the Game Client in conjunction with the Game Server for your non-commercial entertainment purposes only. The foregoing license does not permit you to do any of the following, and you agree that the violation of any of the following license limitations will constitute an infringement of Turbine’s copyrights:

You may not sell, license or transfer the Game Client, or any reproductions thereof, to any person or entity;
You may not post information, screen shots or images of the Game to any website or otherwise publicly display game-play elements of the Game;
You may not develop, distribute or host any server or software designed to interact with the Game Client or to redirect or emulate the communications protocols used by Turbine;
You may not modify the Game Client or any portion thereof;
You may not copy, translate, reverse engineer, derive source code from, modify, disassemble, decompile, or create derivative works based on the Game Client or any part thereof;
You may not use any third party program designed to impact the Game experience, including without limitation software bots, cheats, hacks or any other software designed to provide a player with an advantage;
You may not exploit the Game, or any portion thereof, for any commercial purpose;
You may not connect to the Game Server except by using an authorized, unmodified Game Client as set forth herein; or
You may not use the Game Client to connect to any server or service other than the Game Server.

Eligibility. You must meet certain eligibility requirements to participate in the Preview Program. If you do not meet these requirements, you must refrain from using the Game. To be eligible to participate in the Preview Program, you must (i) not be a principal, agent or an employee of a company that is a publisher, distributor, manufacturer, or a developer of video games (other than Turbine, its parent, affiliates, publishing partners, licensors and licensees); (ii) not be a member of the press; and (iii) be at least 18 years of age. Your participation in the Preview Program is purely voluntary, and you understand and agree that you will receive no compensation for your participation.

Preview Program. As you play the Game, we hope you will provide feedback, suggestions and comments to us regarding your game-play experience, including your thoughts as to usability, bugs, overall impressions, improvements to the Game and any other information relating to the Game (collectively, the “Feedback”). You understand and acknowledge that Turbine may use built-in tracking features to obtain information regarding your use of the Game, and agree that this information and the Feedback is the exclusive property of Turbine and may be used by Turbine (and/or its affiliates, publishing partners, licensors and licensees) in accordance with the Warner Bros. Entertainment Group Privacy Policy, which can be accessed at the following website: http://www.warnerbros.com/#/page=privacy-policy/

Program Confidentiality. During your participation in the Preview Program, you will have access to non-public information concerning the Game, including without limitation the Game design, look and feel, computer software, game concepts, storylines, features, screen shots, characters, graphics, audio, images, virtual items, Feedback, business methods, Turbine updates, release schedules, information about other players or other information that is not generally known (collectively, the “Confidential Information”). The Confidential Information is proprietary to Turbine (or its affiliates, publishing partners, licensors or licensees), and you agree to treat as confidential all Confidential Information of which you become aware in connection with your participation in the Preview Program, regardless of whether it is in written, oral, electronic or other form. As a participant, you must maintain all Confidential Information in strict confidence, may not disclose or permit access to Confidential Information to anyone other than Turbine, or discuss Confidential Information with anyone except within the Game itself or on the Preview Program’s discussion boards located at DDO Forums.

Term. This EULA is effective until terminated, and those provisions which by their nature should survive termination shall survive termination, including without limitation those provisions addressing license limitations, disclaimer of warranties, limitation of liability, indemnification, program confidentiality and ownership. You may terminate this EULA at any time by permanently destroying all copies of the Game and related documentation in your possession, including without limitation any and all Game Clients installed on computers under your custody or control. Turbine may terminate this Agreement at any time for any reason or no reason by providing notice to you, including without limitation email notice to the last email address provided by you. Upon termination of this Agreement, you must (a) destroy all copies of the Game and related documentation in your possession, including without limitation any and all Game Clients installed on your computers; and (b) turn over to Turbine all copies of the Feedback and all copies of documents or other media in any form, written or electronic, which contain Confidential Information.

Ownership. You agree that, between you and Turbine, Turbine owns and shall continue to own all rights, title and interest in and to the Game, all copies thereof, and all content therein. The Game is protected by the copyright laws of the United States, international treaties and other laws. The Game may contain materials licensed by third parties, and the licensors of those materials are third party beneficiaries of this Agreement with the right to enforce their rights against you if you violate this Agreement. You agree that Turbine owns all rights and title in and to all Feedback and all ideas and inventions communicated by you to Turbine in connection with the Game, and that Turbine and its licensors may use, copy, modify, distribute, sublicense, create derivate works based on, and commercially exploit any such Feedback, ideas and inventions without restriction. To the extent that any portion of the Feedback is protectable by copyright, patent, trade secret, trademark or other intellectual property rights, you agree to assign, and hereby assign, irrevocably all right, title and interest in and to the Feedback and all related rights to Turbine.

Consent to Monitor. When the Game is running, Turbine may monitor your computer for the use of programs that violate Section 1. You hereby grant Turbine permission to monitor your computer for purposes of identifying such use and communicating potential violations to the Game Server.

DISCLAIMER OF WARRANTIES.THE GAME IS PROVIDED TO YOU ON AN “AS IS” “AS AVAILABLE” BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGMMENT AND AVAILABILITY.

LIMITATION OF LIABILITY.IN NO EVENT SHALL TURBINE, ITS PARENT, SUBSIDIARIES OR AFFILIATES BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF OR RELATING TO THE GAME OR ANY USE THEREOF, INCLUDING WITHOUT LIMITATION ANY LOSS OF DATA OR GOODWILL, DISRUPTION OF SERVICE OR CLAIMS OF THIRD PARTIES. IN NO EVENT SHALL TURBINE, ITS PARENT, SUBSIDIARIES OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, LIQUIDATED, OR OTHER CONSEQUENTIAL DAMAGES, WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, ARISING FROM YOUR USE OF THE GAME. THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. You acknowledge that this pre-release version of the Game is a work-in-progress and may contain bugs which may cause loss of data, damage or malfunction of your computer, and you agree that Turbine shall not be liable for any such damages. In no event shall Turbine's aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed the total fees paid by you to Turbine during the six (6) months immediately prior to the time such claim arose.

INDEMNIFICATION. YOU HEREBY AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS TURBINE, ITS PARENT, SUBSIDIARIES AND AFFILIATES, FROM AND AGAINST ANY CLAIM, LIABILITY, INJURY, DAMAGE, LOSS OR EXPENSE (INCLUDING REASONABLE ATTORNEYS’ FEES) INCURRED AS A RESULT OF, ARISING FROM, OR RELATING TO YOUR USE OF THE GAME.

Changes to Agreement and Game.Turbine may update this Agreement at its sole discretion, and you will be asked to review and agree to the revised version of the EULA once it becomes effective. If you do not agree to a revised EULA, you will not be permitted to continue playing the Game. If at any time you are no longer able to comply with the terms of the then-current EULA, you must terminate this Agreement pursuant to Section 5 and immediately stop using the Game. Turbine may change, modify, suspend, or discontinue any aspect of the Game at any time. Turbine may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability. You have no interest, monetary or otherwise, in any feature or content contained in the Game.

Patches and Updates. Turbine may apply patches, updates and modifications (collectively, “Updates”) to the Game at any time, including Updates to the Game Client installed on your computer. Updates are not optional. You agree that Turbine may deploy and install updates remotely, with or without your knowledge, and you hereby provide your consent for Turbine to download and apply such Updates.

Remedies. You acknowledge that Turbine may suffer irreparable damage if you breach any of the provisions governing license limitations, confidentiality or ownership. You therefore agree that if you do breach any of these provisions, in addition to provable damages and reasonable attorneys’ fees, Turbine shall be entitled to enjoin such breach and to obtain specific performance of such provisions in any court of competent jurisdiction.

Miscellaneous. You agree that you are not considered, and shall not represent yourself as, an agent, employee, joint venturer, or partner of Turbine. You may not assign this Agreement, in whole or in part, without Turbine’s prior written consent and any attempted assignment in violation of this provision shall be null and void. No waiver of any default, condition or breach of this Agreement shall constitute a waiver of any other default, condition or breach of this Agreement, whether of a similar nature or otherwise. Any provision found unlawful by a court or regulator having jurisdiction shall be deemed to be severed from the Agreement, but such severance shall have no effect on the enforceability of the remaining provisions of the Agreement. This Agreement shall be governed by the laws of California and you and Turbine both agree to submit to the jurisdiction of, and waive any objections to the venue of, the state and federal courts located in Los Angeles, California. This Agreement, incorporating all the applicable documents referenced herein, represents the entire agreement between you and Turbine with respect to Game Client and the Dungeons & Dragons Online™ Preview Program. You must supply all necessary facilities, utilities and equipment necessary to play the Game, including appropriate computer equipment and Internet connections, at your sole risk and expense.

Vielen Dank für Ihr Interesse an dem Vorschauprogramm („Vorschauprogramm“ oder „Vorschau“) für das über das Internet gespielte Rollenspiel mit vielen Teilnehmern „Dungeons and Dragons Online(TM)“ (das „Spiel“) von Turbine, Inc. („Turbine“). DIESE VEREINBARUNG IST RECHTSBINDEND: BITTE LESEN SIE DIESE SORGFÄLTIG DURCH.
Mit Hilfe des Vorschauprogramms hoffen wir, Ihnen eine Möglichkeit zu bieten, die Vorabversion des Spiels zu erleben und zu testen, bevor der Titel veröffentlicht wird. Wichtiger Hinweis: Es kann sein, dass Sie im Verlauf des Vorschauprogramms nur einen unvollständigen Teilbereich des Spiels zu Gesicht bekommen, der nicht der Verkaufsversion ähneln muss. Wir hoffen, dass Sie sich darüber genauso freuen wie wir.

Ihre Teilnahme am Vorschauprogramm, die den Gebrauch des a) Softwareprogramms (des „Spiel-Clients“), b) der Online-Komponente von Turbine (des „Spiel-Servers“) und c) etwaiger zusammen mit dem Spiel-Client, dem Spiel-Server, also dem „Spiel“, bereitgestellten Aktualisierungen („Updates“) oder Erweiterungen umfasst, unterliegt dieser Endbenutzerlizenz- und Vorschauvereinbarung (der „EULA“ oder „Vereinbarung“) und den Nutzungsbedingungen (den „TOS“), die durch die folgende Bezugnahme Bestandteil dieser Vereinbarung werden: Nutzungsbedingungen

Eingeschränkte Lizenz. Der Spiel-Client wird lizenziert und nicht verkauft. Sofern Sie sich zur fortwährenden Einhaltung der Nutzungsbedingungen dieser EULA einverstanden erklären, gewährt Turbine Ihnen hiermit eine eingeschränkte, widerrufliche, nicht ausschließliche Lizenz, die es Ihnen gestattet, a) den Spiel-Client auf Ihren Computer zu laden und darauf zu installieren und b) ein Exemplar des Spiel-Clients zusammen mit dem Spiel-Server zu Ihrer nicht gewerblichen Unterhaltung zu nutzen. Die vorgenannte Lizenz befugt Sie nicht, die nachfolgend beschriebenen Handlungen durchzuführen. Sie stimmen zu, dass ein Verstoß gegen eine der folgenden Lizenzbeschränkungen eine Verletzung der Urheberrechte von Turbine darstellt:

Sie dürfen den Spiel-Client oder Vervielfältigungen davon nicht an natürliche oder juristische Personen verkaufen, lizenzieren oder übertragen.
Sie dürfen keine Informationen, Bildschirmfotos („Screenshots“) oder Bilder des Spiels auf Websites veröffentlichen oder Elemente des Spiels auf sonstige Weise öffentlich zur Schau stellen.
Sie dürfen keine Server oder Software zur Interaktion mit dem Spiel-Client oder zur Emulation oder Umleitung der Kommunikationsprotokolle von Turbine entwickeln, vertreiben oder bereitstellen.
Sie dürfen den Spiel-Client weder ganz noch teilweise ändern.
Sie dürfen den Spiel-Client weder ganz noch teilweise kopieren, übersetzen, zurückentwickeln, Quellcode davon ableiten, modifizieren, disassemblieren, dekompilieren oder abgeleitete Werke daraus herstellen.
Sie dürfen kein Drittanbieter-Programm zum Beeinflussen des Spielverlaufs benutzen. Hierzu gehören insbesondere Bot-, Cheat- und Hack-Programme oder jegliche andere Software, die darauf abzielt, Spielern einen Vorteil zu verschaffen.
Sie dürfen das Spiel weder ganz noch teilweise kommerziell verwerten.
Sie dürfen nur mit einem wie hier dargelegten genehmigten und nicht modifizierten Spiel-Client Verbindungen zum Spiel-Server herstellen.
Sie dürfen den Spiel-Client nur zum Verbindungsaufbau mit dem Spiel-Server benutzen, nicht zum Verbindungsaufbau mit anderen Diensten oder Servern.

Teilnahme. Sie müssen bestimmte Bedingungen erfüllen, um an dem Vorschauprogramm teilzunehmen. Wenn Sie diese Bedingungen nicht erfüllen, dürfen Sie das Spiel nicht benutzen. Um die Teilnahmebedingungen für das Vorschauprogramm zu erfüllen, dürfen Sie i) nicht zu den Teilhabern, Bevollmächtigten oder Angestellten eines Unternehmens gehören, das Videospiele veröffentlicht, vertreibt, herstellt oder entwickelt. Ausgenommen davon ist die Firma Turbine, ihre Muttergesellschaft, Tochtergesellschaften, Verlagspartner, Lizenzgeber und Lizenznehmer. Sie dürfen ii) keine Journalistin oder Journalist sein und müssen iii) mindestens 18 Jahre alt sein. Ihre Teilnahme an dem Vorschauprogramm erfolgt rein freiwillig. Es ist Ihnen bewusst, und Sie sind damit einverstanden, dass Sie keine Entlohnung für Ihre Teilnahme erhalten.

Vorschauprogramm. Wir hoffen, dass Sie uns im Verlauf des Spiels Ihre Kommentare, Vorschläge und Meinungen in Bezug auf Ihre Erfahrungen damit schicken. Dazu gehört insbesondere Ihre Meinung über die Bedienbarkeit, Fehler, den allgemeinen Eindruck und Verbesserungen des Spiels sowie alle anderen Informationen, die sich unter dem Sammelbegriff: „Feedback“ auf das Spiel beziehen. Es ist Ihnen bewusst, und Sie sind damit einverstanden, dass Turbine integrierte Nachverfolgungsfunktionen einsetzen darf, um Informationen darüber zu gewinnen, wie Sie das Spiel benutzen. Sie sind damit einverstanden, dass diese Informationen und das Feedback alleiniges Eigentum von Turbine sind und von Turbine und/oder dessen Tochtergesellschaften, Verlagspartnern, Lizenzgebern und Lizenznehmern in Übereinstimmung mit den Datenschutzrichtlinien der Warner Bros. Entertainment Group verwendet werden dürfen, die Sie auf der folgenden Website einsehen können: http://www.warnerbros.com/#/page=privacy-policy/

Vertraulichkeit des Programms. Während Ihrer Teilnahme an dem Vorschauprogramm haben Sie Zugriff auf nicht öffentliche Informationen über das Spiel. Dazu gehören insbesondere dessen Design, Erscheinungsbild und Bedienbarkeit, Computersoftware, Konzepte, Handlungen, Merkmale, Bildschirmfotos, Charaktere, Grafiken, Klänge, Bilder, virtuelle Gegenstände, Feedback, Geschäftsmethoden, Aktualisierungen durch Turbine, Veröffentlichungstermine, Informationen über andere Spieler oder sonstige Informationen, die nicht allgemein bekannt sind (Sammelbegriff: „Vertrauliche Informationen“). Diese Vertraulichen Informationen sind Eigentum von Turbine oder dessen Tochtergesellschaften, Verlagspartnern, Lizenzgebern oder Lizenznehmern, und Sie erklären sich damit einverstanden, Vertrauliche Informationen, auf die Sie im Rahmen Ihrer Teilnahme an dem Vorschauprogramm aufmerksam werden, vertraulich zu behandeln, unabhängig davon, ob diese Ihnen auf schriftliche, mündliche, elektronische oder sonstige Weise zugetragen werden. Als Teilnehmer müssen Sie alle Vertraulichen Informationen streng vertraulich behandeln und dürfen niemandem außer Turbine Vertrauliche Informationen offenlegen oder Zugriff darauf gewähren. Sie dürfen Vertrauliche Informationen nur im Spiel selbst oder in den für das Vorschauprogramm eingerichteten Diskussionsforen unter DDO Forums besprechen.

Laufzeit. Diese Endbenutzerlizenzvereinbarung bleibt bis zu deren Kündigung in Kraft. Die Bedingungen, die aufgrund ihrer Art nach der Kündigung gültig bleiben, bleiben nach der Kündigung wirksam. Dies betrifft insbesondere die Bedingungen bezüglich Lizenzbeschränkungen, Haftungsausschluss, Haftungsbeschränkung, Vertraulichkeit des Programms, Schadensersatz und Eigentum. Sie können diese Endbenutzerlizenzvereinbarung jederzeit kündigen, indem Sie sämtliche Kopien des Spiels und damit verbundener Dokumentation, die sich in Ihrem Besitz befinden, endgültig vernichten. Dies gilt insbesondere für alle Spiel-Clients auf Ihren Computern oder solchen, auf die Sie Zugriff haben. Turbine kann diese Vereinbarung jederzeit aus beliebigem Grund oder ohne Angabe von Gründen kündigen. Dies kann insbesondere durch eine E-Mail-Mitteilung an die letzte von Ihnen bekannte E-Mail-Adresse erfolgen. Nach Kündigung dieser Vereinbarung müssen Sie a) sämtliche Exemplare und Begleitdokumentationen des Spiels in Ihrem Besitz vernichten. Das gilt insbesondere für alle auf Ihren Computern installierten Spiel-Clients. Außerdem müssen Sie b) Turbine alle Exemplare von Feedback sowie alle Exemplare schriftlicher oder elektronischer Dokumente oder anderer Medien in jedweder Form, die Vertrauliche Informationen enthalten, aushändigen.

Eigentum. Sie erklären sich damit einverstanden, dass laut den Vereinbarungen zwischen Ihnen und Turbine jegliche Eigentums- und sonstige Rechte an dem Spiel sowie Ansprüche auf das Spiel, dessen Kopien und Inhalte bei Turbine verbleiben und verbleiben werden. Das Spiel ist durch das Urheberrecht der Vereinigten Staaten von Amerika, internationale Urheberrechtsabkommen und andere Gesetze geschützt. Das Spiel enthält möglicherweise Inhalte, die von Dritten lizenziert wurden. Die Lizenzgeber der jeweiligen Inhalte sind Drittbegünstigte dieser Vereinbarung und können ihre Rechte Ihnen gegenüber durchsetzen, wenn Sie gegen diese Vereinbarung verstoßen. Sie erklären sich damit einverstanden, dass Turbine Eigentümer aller Rechte und Rechtsansprüche am gesamten Feedback sowie aller Ideen und Erfindungen ist, die Sie im Zusammenhang mit dem Spiel an Turbine übermittelt haben, und dass Turbine und seine Lizenzgeber derartiges Feedback, Ideen und Erfindungen ohne Einschränkung benutzen, kopieren, ändern, verbreiten, Unterlizenzen dafür vergeben, abgeleitete Werke daraus herstellen und kommerziell verwerten dürfen. Sollte das Feedback ganz oder teilweise durch Urheber-, Patent-, Geschäftsgeheimnis-, Marken- oder andere Rechte zur Wahrung des geistigen Eigentums geschützt werden können, erklären Sie sich damit einverstanden, dass Sie alle Rechte, Eigentumsrechte und Ansprüche an dem Feedback sowie alle damit verbundenen Rechte hiermit an Turbine abtreten.

Zustimmung zur Überwachung. Wenn das Spiel läuft, darf Turbine Ihren Computer auf Programme überwachen, die gegen Abschnitt 1 verstoßen. Sie erteilen Turbine hiermit die Erlaubnis, Ihren Computer zum Zwecke der Identifizierung solcher Anwendungen zu überwachen und dem Spiel-Server mögliche Verstöße zu melden.

HAFTUNGSAUSSCHLUSS. DAS SPIEL WIRD OHNE MÄNGELGEWÄHR UND OHNE AUSDRÜCKLICHE ODER STILLSCHWEIGENDE ZUSICHERUNGEN ODER GEWÄHRLEISTUNGEN BEREITGESTELLT. DAZU ZÄHLEN INSBESONDERE DIE MARKTGÄNGIGKEIT, DIE EIGNUNG FÜR EINEN BESTIMMTEN ZWECK, DIE RECHTSMÄNGELFREIHEIT UND VERFÜGBARKEIT.

HAFTUNGSBESCHRÄNKUNG. TURBINE, SEINE MUTTER-, TOCHTER- UND PARTNERUNTERNEHMEN HAFTEN IN KEINEM FALL FÜR VERLUSTE ODER SCHÄDEN, DIE SICH DURCH DAS SPIEL ODER IN ZUSAMMENHANG MIT DEM SPIEL ODER DESSEN GEBRAUCH ERGEBEN. DAZU GEHÖREN INSBESONDERE DATEN- ODER GESCHÄFTSWERTVERLUSTE, DIENSTEUNTERBRECHUNGEN ODER ANSPRÜCHE DRITTER. TURBINE, SEINE MUTTER-, TOCHTER- UND PARTNERUNTERNEHMEN HAFTEN IN KEINEM FALL FÜR MITTELBARE ODER BEILÄUFIG ENTSTANDENE SCHÄDEN, ECHTEN ODER KOMPENSATORISCHEN STRAFSCHADENERSATZ, VERTRAGSSTRAFEN ODER ANDERE FOLGESCHÄDEN, DIE SICH AUS IHREM GEBRAUCH DES SPIELS ERGEBEN, UNABHÄNGIG DAVON, OB DIESE SICH AUS EINEM VERTRAG, EINER UNERLAUBTEN HANDLUNG (EINSCHLIESSLICH FAHRLÄSSIGKEIT), GEFÄHRDUNGSHAFTUNG ODER EINER ANDEREN HAFTUNGSTHEORIE ABLEITEN LASSEN. DIE VORGENANNTEN BESCHRÄNKUNGEN GELTEN BIS ZUM MAXIMAL RECHTLICH ZULÄSSIGEN AUSMASS, SELBST WENN NACHBESSERUNGEN IHREN WESENTLICHEN ZWECK VERFEHLEN. Es ist Ihnen bewusst, dass die Arbeiten an dieser Vorabversion des Spiels noch nicht beendet sind, und dass die Vorabversion Fehler enthalten kann, die zu Datenverlusten, Schäden oder Fehlfunktionen an Ihrem Computer führen können, und Sie erklären sich damit einverstanden, dass Turbine für solche Schäden nicht haftet. Die Gesamthaftung von Turbine, die sich aus einem Vertrag, einer unerlaubten Handlung, Gefährdungshaftung oder einer sonstigen Haftungstheorie ableiten lässt, übersteigt in keinem Fall die Summe der Kosten, die Sie in den sechs (6) Monaten unmittelbar vor Geltendmachung Ihrer Forderung an Turbine gezahlt haben.

SCHADENSERSATZ. SIE ERKLÄREN SICH DAMIT EINVERSTANDEN, TURBINE, SEINE MUTTER-, TOCHTER- UND PARTNERUNTERNEHMEN GEGEN ANSPRÜCHE, HAFTUNGSFORDERUNGEN, RECHTSVERLETZUNGEN, SCHÄDEN, VERLUSTE ODER KOSTEN (EINSCHLIESSLICH ANWALTSKOSTEN) SCHADLOS ZU HALTEN, DIE AUS IHREM GEBRAUCH DES SPIELS ENTSTEHEN.

Änderungen der Vereinbarung und des Spiels. Turbine kann die Vereinbarung nach eigenem Ermessen ändern. Sie werden gebeten, die überarbeitete Version dieser EULA zu prüfen und dieser zuzustimmen, sobald sie wirksam wird. Falls Sie der überarbeiteten Endbenutzerlizenzvereinbarung nicht zustimmen, dürfen Sie das Spiel nicht weiter benutzen. Falls Sie die aktualisierte Endbenutzerlizenzvereinbarung nicht mehr erfüllen können, müssen Sie diese Vereinbarung laut Abschnitt 4 kündigen und die Nutzung des Spiels umgehend einstellen. Turbine kann das Spiel jederzeit ganz oder teilweise ändern, modifizieren, sperren oder einstellen. Turbine kann außerdem bestimmte Funktionen des Spiels einschränken oder Ihren Zugriff auf das Spiel oder Teile davon einschränken, ohne Sie darüber zu benachrichtigen oder sich Ihnen gegenüber haftbar zu machen. Sie haben weder einen finanziellen noch einen anderweitigen Anspruch auf die Funktionen oder Inhalte des Spiels.

Patches and Updates. Turbine kann jederzeit Patches, Updates und Modifikationen (Sammelbegriff: „Aktualisierungen“) auf das Spiel anwenden. Dazu zählen auch Updates für den Spiel-Client auf Ihrem Computer. Updates müssen installiert werden. Sie erklären sich damit einverstanden, dass Turbine Updates mit oder ohne Ihr Wissen per Fernzugriff überträgt und installiert, und Sie geben hiermit Turbine Ihr Einverständnis, solche Updates herunterzuladen und anzuwenden.

Rechtsmittel. Sie erkennen an, dass Turbine einen irreparablen Schaden erleiden kann, falls Sie gegen eine der Bedingungen bezüglich der Lizenzbeschränkungen, der Vertraulichkeit oder des Eigentums verstoßen. Sie erklären sich daher damit einverstanden, dass Sie bei einem Verstoß gegen eine dieser Bedingungen von Turbine bei jedem zuständigen Gericht auf Zahlung von nachweisbarem Schadensersatz und Anwaltskosten haftbar gemacht werden können, und die Erfüllung solcher Bedingungen verlangt werden kann.

Verschiedenes. Sie bestätigen, dass Sie nicht für einen Stellvertreter, Mitarbeiter, Mitunternehmer oder Partner von Turbine gehalten werden und sich nicht als solchen ausgeben. Sie können diese Vereinbarung nicht ohne vorherige Zustimmung seitens Turbine ganz oder teilweise abtreten. Abtretungsversuche, die gegen diese Bedingung verstoßen, sind unwirksam. Die Nichtgeltendmachung einer Schlechterfüllung, Bedingung oder eines Verstoßes gegen diese Vereinbarung führt nicht zu einem Verzicht der Geltendmachung einer späteren Schlechterfüllung, Bedingung oder eines Verstoßes, unabhängig davon, ob diese(r) ähnlich ist. Eine Bestimmung, die von einem Gericht oder einer zuständigen Behörde als unwirksam erachtet wird, wird von der Vereinbarung ausgeschlossen. Dies hat jedoch keine Auswirkung auf die Durchsetzbarkeit der übrigen Bedingungen der Vereinbarung. Diese Vereinbarung unterliegt dem Recht des US-Bundesstaats Kalifornien. Sie und Turbine erklären sich mit der Zuständigkeit der Staats- und Bundesgerichte in Los Angeles, Kalifornien einverstanden und verzichten auf einen Einspruch gegen diesen Gerichtsstand. Diese Vereinbarung und alle zugehörigen Dokumente, auf die hier verwiesen wird, stellen die gesamte Vereinbarung zwischen Ihnen und Turbine in Bezug auf den Spiel-Client auf das Vorschauprogramm „Dungeons and Dragons Online“ dar. Alle erforderlichen Einrichtungen, Hilfsmittel und Geräte für die Benutzung des Spiels wie die entsprechende Computerausstattung und Internetverbindung sind von Ihnen auf eigene Gefahr und Kosten bereitzustellen.

Merci de votre intérêt pour le Programme de prévisualisation (le « Programme de prévisualisation » ou « Prévisualisation ») de Turbine, Inc (« Turbine ») du jeu de rôle en ligne massivement multijoueur Dungeons and Dragons Online™ (le « Jeu »). CECI EST UN CONTRAT EXÉCUTOIRE ; VEUILLEZ LE LIRE ATTENTIVEMENT.

Nous espérons, grâce à ce Programme de prévisualisation, vous donner la chance de découvrir la préversion du Jeu et de nous aider à le tester avant qu’il ne soit mis à la disposition du public. Veuillez noter qu’il est probable que dans le Programme de prévisualisation, le jeu présente des portions incomplètes et qu’il ne ressemble pas forcément à la version finale. Nous espérons que vous partagerez notre enthousiasme.

Votre participation au Programme de prévisualisation, y compris l'utilisation du (a) logiciel (le « Client de jeu »), du (b) composant en ligne de Turbine (le « Serveur de jeu »), et des (c) mises à jour ou des extensions fournies par Turbine (collectivement, avec le Client de jeu et le Serveur de jeu, « le Jeu ») est soumise à ce Contrat de licence et de prévisualisation pour utilisateur final (le « CLUF » ou « Contrat ») et aux Conditions de service (les « CS ») ci-incluses sous la référence suivante : Conditions de service.

Licence limitée. Dans le cas où vous acceptez et respectez les conditions d'utilisation du présent CLUF, Turbine vous permet par le présent texte d'obtenir une licence limitée, révocable et non-exclusive afin (a) de télécharger et installer un exemplaire unique du Client du jeu sur un ordinateur privé vous appartenant, et (b) d’utiliser le Client du jeu conjointement au serveur du jeu à des fins ludiques non-commerciales uniquement. Ladite licence vous interdit les activités suivantes, qui constituent une infraction aux droits d'auteur de Turbine :

Vous ne pouvez vendre, transférer le Client du jeu ou en octroyer une licence, ou toute reproduction de ce dernier, à aucune personne ou entité;
Vous ne pouvez publier d’informations, de copies d’écran ou de photos du Jeu sur un site Internet quel qu’il soit, ni mettre à la disposition du public des composants du Jeu;
Vous ne pouvez développer, distribuer ou héberger aucun serveur ou logiciel destiné à interagir avec le Client du jeu ou pour rediriger ou émuler les protocoles de communications utilisés par Turbine;
Vous ne pouvez modifier le Client de Jeu ni une portion de celui-ci, quelle qu’elle soit;
Vous ne pouvez copier, traduire, désosser, obtenir le code source, modifier, désassembler, décompiler ou créer des travaux dérivés du Client du jeu ou d’une portion de celui-ci;
Vous ne pouvez utiliser tout autre programme tiers destiné à modifier le Jeu, incluant sans restriction les bots, les codes de triche, les codes de piratage, ou tout autre logiciel destiné à avantager le joueur;
Vous ne pouvez exploiter le Jeu ou toute partie de ce dernier à des fins commerciales;
Vous ne pouvez vous connecter au Serveur du jeu qu'à l'aide d'un Client du jeu non modifié et autorisé par le présent texte; ou
Vous ne pouvez utiliser le Client du jeu pour vous connecter à aucun serveur ou service autre que le Serveur du jeu.

Admissibilité. Pour participer au Programme de prévisualisation, vous devez répondre à certains critères d’admissibilité. Si vous ne remplissez pas ces conditions, merci de vous abstenir d’utiliser le Jeu. Pour être admissible et pouvoir participer au Programme de prévisualisation, vous devez (i), ne pas être directeur, agent, ou employé d’une société agissant comme distributeur, fabricant, ou développeur de jeux vidéo (autres que Turbine, sa maison-mère, ses filiales, partenaires d’édition, concédants et licenciés) ; (ii) ne pas être membre de la presse ; et ( iii) avoir au moins 18 ans. Votre participation au Programme de prévisualisation est entièrement volontaire, vous reconnaissez et acceptez donc qu’il ne vous sera accordé aucune indemnisation en échange.

Programme de prévisualisation. Quand vous jouez au jeu, nous aimerions que vous nous communiquiez vos impressions, vos suggestions et commentaires sur votre expérience de jeu, y compris ce que vous pensez de sa convivialité, vos commentaires sur les bogues, vos impressions d’ensemble, quelles améliorations pourraient être apportées au Jeu, et toute autre information concernant celui-ci (collectivement, le « Feedback »). Vous comprenez et reconnaissez que Turbine peut à l’occasion utiliser des fonctions de suivi intégrées afin d’obtenir des informations sur votre utilisation du Jeu, et reconnaissez que ces informations tout comme le Feedback sont la propriété exclusive de Turbine et qu’elles peuvent être utilisées par Turbine (et/ou ses filiales, partenaires d’édition, concédants et licenciés) conformément à la Politique de confidentialité de Warner Bros. Entertainment Group, que vous pouvez consulter à l’adresse suivante : http://www.warnerbros.com/#/page=privacy-policy/.

Confidentialité du programme. Pendant toute votre participation au Programme de prévisualisation, vous aurez accès à des informations non-publiques sur le Jeu, y compris, mais sans que cette liste soit exhaustive, à la Conception du jeu, à son aspect et sa convivialité, au logiciel, aux concepts de jeu, aux histoires, aux fonctions, aux captures d’écran, aux personnages, aux graphismes, aux fonctions audio, aux images, aux objets virtuels, au Feedback, aux méthodes commerciales, aux mises à jour Turbine, aux calendriers des versions, aux informations sur d’autres joueurs ou à des renseignements qui ne seraient normalement pas divulgués, (collectivement, à des « Informations confidentielles »). Les Informations confidentielles sont la propriété de Turbine (ou de ses filiales, de ses partenaires d’édition, de ses concédants ou de ses licenciés), et vous vous engagez à traiter comme confidentielles toutes les informations confidentielles dont vous aurez connaissance dans le cadre de votre participation au Programme de prévisualisation, que ce soit sous forme écrite, orale, électronique ou sous n’importe quelle autre forme. En tant que participant, vous devez préserver le caractère totalement confidentiel des renseignements auxquels vous avez accès, vous n’êtes pas autorisé à divulguer ou à autoriser l’accès aux informations confidentielles à quiconque autre que Turbine, ou à discuter de renseignements confidentiels avec quiconque, sauf au sein du Jeu lui-même, ou sur les forums de discussion du Programme de prévisualisation sur DDO Forums.

Terme. Le présent CLUF est en vigueur jusqu'à sa résiliation. Les clauses qui par nature doivent rester en vigueur après la résiliation du présent contrat resteront en vigueur, incluant sans restriction les clauses relatives aux restrictions de licence, décharges de garanties, limite de responsabilité, indemnisation, confidentialité du programme et propriété. Vous pouvez résilier le présent CLUF à tout moment en détruisant de façon définitive toutes les copies du Jeu ainsi que la documentation associée que vous avez en votre possession, incluant sans restriction tout Client du jeu installé sur les ordinateurs se trouvant sous votre garde/contrôle. Turbine se réserve le droit de résilier ce Contrat à tout moment pour toute raison ou aucune raison, en vous fournissant un préavis raisonnable, incluant sans restriction un préavis électronique envoyé à la dernière adresse électronique que vous nous avez communiquée. Dès résiliation du présent Contrat, vous devez (a) détruire toute copie du Jeu ainsi que toute documentation associée que vous avez en votre possession, incluant sans restriction tout Client du jeu installé sur vos ordinateurs ; et (b) remettre à Turbine tous les exemplaires de Feedback et tous les exemplaires de documents ou autres supports fournis, qu’ils soient écrits, électroniques ou autres, et contenant des données confidentielles.

Propriété. Par le présent Contrat passé entre vous et Turbine, vous acceptez que Turbine possède et continuera de posséder tout droit, titre et avantage dans le Jeu/du Jeu ainsi que de toute copie de ce dernier et de tout contenu de ce dernier. Le Jeu est protégé par les lois de droits d'auteur des États-Unis, des traités internationaux et d’autres lois. Les concédants de ces éléments sont des bénéficiaires tiers du présent Contrat et ont le droit d'exercer leurs droits à votre encontre si vous enfreignez le présent Contrat. Vous reconnaissez que Turbine possède tous les droits et titres de tous les Feedbacks et idées et inventions qui vous sont communiqués par Turbine et en relation avec le Jeu, et que Turbine et ses concédants de licence peuvent utiliser, copier, modifier, distribuer, exploiter, créer des travaux dérivés de, et exploiter commercialement de tels Feedbacks, idées et inventions, sans restriction quelconque. Dans la mesure où une partie du Feedback peut être protégée par les droits d’auteur, les brevets, les secrets commerciaux, les marques déposées ou d’autres droits de propriété intellectuelle, vous acceptez de céder, et de céder irrévocablement, tous les droits, titres et intérêts liés au Feedback ainsi que tous les droits liés à Turbine.

Autorisation de surveillance . Lorsque le Jeu est lancé, il peut arriver que Turbine surveille votre ordinateur afin de vérifier qu’il n’utilise pas des programmes qui violeraient l’Article 1. Par la présente, vous autorisez Turbine à surveiller votre ordinateur à des fins de détection d’utilisations de ce type, et de communication de violations potentielles au Serveur de Jeu.

DÉCHARGE DE GARANTIES. LE JEU VOUS EST FOURNI « EN L'ÉTAT » SANS REPRÉSENTATION OU GARANTIE D'AUCUNE SORTE, EXPRESSE OU TACITE, INCLUANT SANS RESTRICTION LES GARANTIES TACITES DE VALEUR COMMERCIALE, D'ADÉQUATION À UNE UTILISATION QUELCONQUE, DE NON-VIOLATION ET DE DISPONIBILITÉ.

LIMITE DE RESPONSABILITÉ. TURBINE, SES FILIALES ET SES PARTENAIRES NE PEUVENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DES PERTES OU DOMMAGES D'AUCUNE SORTE CAUSÉS OU ASSOCIÉS AU JEU ET/OU AU SERVEUR DU JEU OU À TOUTE UTILISATION DE CES DERNIERS, Y COMPRIS, SANS QUE CETTE LISTE SOIT EXHAUSTIVE, TOUTE PERTE DE DONNÉES OU DE BIENS INCORPORELS, TOUTE PERTURBATION DE SERVICE OU RÉCLAMATION DE TIERCES PERSONNES. TURBINE, SES FILIALES ET SES PARTENAIRES NE PEUVENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DES PERTES OU DOMMAGES D'AUCUNE SORTE CAUSÉS OU ASSOCIÉS AU JEU OU DE TOUTE UTILISATION DE CES DERNIERS, Y COMPRIS, SANS QUE CETTE LISTE SOIT EXHAUSTIVE, TOUTE PERTE DE DONNÉES OU DE BIENS INCORPORELS, TOUTE PERTURBATION DE SERVICE OU RÉCLAMATION DE TIERCES PERSONNES. LESDITES RESTRICTIONS S'APPLIQUENT DANS TOUTE LA MESURE PERMISE PAR LA LOI, MAIS N’EXONÈRENT PAS DE LA RESPONSABILITÉ LIÉE AUX PERTES OU DOMMAGES ASSOCIÉS AUX ATTEINTES CORPORELLES CAUSÉES PAR NÉGLIGENCE, NÉGLIGENCE CARACTÉRISÉE, FAUTE LOURDE, FRAUDE OU TOUTE AUTRE GARANTIE IMPLIQUÉE PAR LA RESPONSABILITÉ LÉGALE À LAQUELLE IL EST IMPOSSIBLE DE SE SOUSTRAIRE. Vous reconnaissez que cette préversion du Jeu est un travail en cours et qu’elle peut contenir des bogues qui pourraient causer la perte de données, des dommages ou des dysfonctionnements de votre ordinateur, et vous acceptez que Turbine ne pourra être tenu responsable de tels dommages. En aucun cas la responsabilité globale de Turbine, qu’elle découle du contrat, d’actes délictuels, de responsabilité absolue ou autre, ne pourra dépasser le total des frais réglés par vous à Turbine, au cours des six (6) derniers mois précédant immédiatement la date de la réclamation.

INDEMNISATION. VOUS ACCEPTEZ PAR LE PRÉSENT TEXTE DE DÉFENDRE, INDEMNISER ET PROTÉGER TURBINE, SES FILIALES ET PARTENAIRES, DE TOUT/TOUTE RÉCLAMATION, RESPONSABILITÉ, DÉGÂT, DOMMAGE, PERTE OU DÉPENSE (NOTAMMENT DES HONORAIRES D'AVOCAT RAISONNABLES) CAUSÉS PAR, VENANT DE OU ASSOCIÉS À VOTRE UTILISATION DU JEU.

Modifications du Contrat et du Jeu. Turbine peut mettre à jour le présent Contrat à sa propre discrétion. Vous devrez relire et accepter la nouvelle version du CLUF dès sa mise en vigueur. Si vous n'acceptez pas la nouvelle version du CLUF, vous ne serez pas autorisé à continuer d'utiliser le Jeu. Si à tout moment, vous n'êtes plus en mesure de respecter les conditions du CLUF en vigueur au moment concerné, vous devez résilier le présent Contrat conformément à la Section 5 et cesser immédiatement d'utiliser le Jeu. Turbine peut à tout moment changer, modifier, suspendre, interrompre ou supprimer tout aspect du Jeu. Également restreindre certaines caractéristiques ou votre accès à tout ou partie du Jeu sans préavis ou obligation. Vous n'avez aucun avantage, monétaire ou autre, sur les caractéristiques ou contenus du Jeu.

Patchs et mises à jour. Turbine peut implémenter des patchs, des mises à jour et des modifications (conjointement, les « Mises à jour ») dans le Jeu à tout moment, incluant des Mises à jour dans le Client du jeu installé sur votre ordinateur. Les Mises à jour ne sont pas optionnelles. Vous autorisez Turbine à déployer et à installer les mises à jours à distance, que vous le sachiez ou non, et vous autorisez Turbine par le présent texte à télécharger et implémenter les dites Mises à jour.

Voies de recours. Vous admettez que Turbine peut subir des dommages irréparables en cas d'infraction des clauses régissant les restrictions de licence, la confidentialité ou la propriété. Par conséquent, si vous enfreignez l'une de ces clauses, en plus de dommages prouvables et d'honoraires d'avocat raisonnables, vous autorisez Turbine à enjoindre ladite infraction et à obtenir une exécution en nature des dites clauses dans tout tribunal compétent.

Divers. Vous acceptez de ne pas être considéré comme étant, et de ne pas vous présenter en tant que, agent, employé, partenaire commercial, ou associé de Turbine. Vous ne pouvez assigner tout ou partie du présent Contrat sans une autorisation écrite de Turbine et toute tentative d'assignation contrevenant à la présente clause sera considérée comme nulle et non avenue. Aucune clause dérogatoire de défaut, condition ou violation du présent Contrat ne peut constituer une clause dérogatoire d'un autre défaut ou d'une autre condition ou violation du présent Contrat, similaire ou non. Toute clause considérée comme illégale par un tribunal ou un organisme de contrôle compétent doit être séparée du présent Contrat, mais ladite séparation n'aura aucun effet sur le caractère applicable des autres clauses du Contrat. Le présent accord sera régi par les lois de la Californie ; Turbine et vous vous engagez à vous soumettre à la juridiction des tribunaux fédéraux situés à Los Angeles (Californie), et à renoncer à toute objection quant au lieu, à l’état aux tribunaux sélectionnés. En intégrant tous les accords pertinents mentionnés dans ce document, ce Contrat représente l’intégralité du contrat établi entre vous et Turbine en ce qui concerne le Client de Jeu et le Programme de prévisualisation du Seigneur des Anneaux en ligne. Vous devez fournir tout matériel, outil et équipement nécessaires à l'utilisation du Jeu, notamment un équipement informatique approprié et une connexion Internet, le tout entièrement à votre charge et à votre risque.
